ਕੇਂਦਰ ਸਰਕਾਰ ਨੇ ਜਲਵਾਯੂ ਕਾਰਕੁਨ ਸੋਨਮ ਵਾਂਗਚੁਕ ਦੀ ਰਾਸ਼ਟਰੀ ਸੁਰੱਖਿਆ ਕਾਨੂੰਨ (NSA) ਤਹਿਤ ਕੀਤੀ ਗਈ ਹਿਰਾਸਤ ਨੂੰ ਉਸ ਸਮੇਂ ਰੱਦ ਕਰ ਦਿੱਤਾ ਜਦੋਂ ਸੁਪਰੀਮ ਕੋਰਟ ਉਸ ਦੀ ਗ੍ਰਿਫ਼ਤਾਰੀ ਦੀ ਕਾਨੂੰਨੀ ਪੱਖ ਨੂੰ ਚੁਣੌਤੀ ਦੇਣ ਵਾਲੀ ਹੈਬੀਅਸ ਕਾਰਪਸ ਪਟੀਸ਼ਨ ’ਤੇ ਮੁੜ ਸੁਣਵਾਈ ਕਰਨ ਵਾਲੀ ਸੀ। ਸਰਕਾਰ ਦਾ ਕਹਿਣਾ ਹੈ ਕਿ ਇਹ ਕਦਮ ਲੱਦਾਖ ਵਿੱਚ ਸ਼ਾਂਤੀ ਬਹਾਲ ਕਰਨ ਅਤੇ ਸੰਵਾਦ ਨੂੰ ਅੱਗੇ ਵਧਾਉਣ ਲਈ ਚੁੱਕਿਆ ਗਿਆ ਹੈ, ਪਰ ਆਲੋਚਕਾਂ ਦਾ ਮੰਨਣਾ ਹੈ ਕਿ ਇਸ ਫੈਸਲੇ ਦੇ ਸਮੇਂ ਨੇ ਇਹ ਸਵਾਲ ਖੜ੍ਹਾ ਕਰ ਦਿੱਤਾ ਹੈ ਕਿ ਕੀ ਇਸ ਨਾਲ ਮੁੱਢਲੀ ਹਿਰਾਸਤ ਦੀ ਕਾਨੂੰਨੀ ਪੱਖ ’ਤੇ ਹੋਣ ਵਾਲੀ ਨਿਆਂਇਕ ਜਾਂਚ ਤੋਂ ਬਚਣ ਦੀ ਕੋਸ਼ਿਸ਼ ਹੋਈ। ਜਦੋਂ ਅਦਾਲਤਾਂ ਕਿਸੇ ਹਿਰਾਸਤ ਦੀ ਕਾਨੂੰਨੀ ਪੱਖ ਦੀ ਜਾਂਚ ਕਰਨ ਵਾਲੀਆਂ ਹੋਣ ਅਤੇ ਉਸ ਤੋਂ ਠੀਕ ਪਹਿਲਾਂ ਹਿਰਾਸਤ ਦਾ ਹੁਕਮ ਰੱਦ ਕਰ ਦਿੱਤਾ ਜਾਵੇ, ਤਾਂ ਕੀ ਇਸ ਨਾਲ ਇਹ ਖਤਰਾ ਪੈਦਾ ਹੁੰਦਾ ਹੈ ਕਿ ਕਾਰਜਕਾਰੀ ਦੇ ਫੈਸਲੇ ਸਪੱਸ਼ਟ ਸੰਵਿਧਾਨਕ ਜਾਂਚ ਤੋਂ ਬਚ ਸਕਦੇ ਹਨ ?
